EOIR Launches Respondent Access Portal

EOIR Launches Respondent Access Portal

On July 2, 2024, EOIR sent out a Stakeholder Update by email announcing the launch of the Respondent Access Portal. Per the announcement, this will be a phased enrollment which will allow unrepresented respondents to access the Electronic Record of Proceedings for their Immigration Court (EOIR) case. This will make it much easier for unrepresented respondents to keep track of their removal proceedings, stay informed about rescheduled hearing dates, and submit evidence to the Court. EOIR Stakeholder UpdateEOIR today announced it has launched Respondent Access Portal, part of the Access EOIR Initiative. Through a phased enrollment, Respondent Access Portal will allow unrepresented individuals who have cases before EOIR to view their case information, keep informed about hearing schedules, download electronic Records of Proceedings, and file case-related documents. Unrepresented adult noncitizens will receive an official notice from the immigration court. Please see the agency notice for more details. Check Your Immigration Court Case Status Online

Automated Case Status System Check the status of your EOIR case online. You can use the Automated Case Status System to find out the date & time of your next Immigration Court hearing, the location of your hearing, the Immigration Judge assigned to your case, and other important information about your case. You can find the online ACSS at the url: https://acis.eoir.justice.gov/en/     STEP STEP 1 Go to the Automated Case Status System Website Go to the automated case status system website at: https://acis.eoir.justice.gov/en/ Have your A Number because that is how you will lookup your case.  STEP STEP 2 Click ACCEPT You will be greeted with a pop-up disclaimer message. Read the disclaimer and click accept (the blue button on the bottom left of the pop-up) in order to proceed. STEP STEP 3 Enter your A Number There will be 9 text boxes where you can enter one digit per box. This is where you will enter your A Number putting one number in each box.  Make sure you watch as you are typing to be sure that each box has one number and that when you are done it matches your A Number as it appears on your paperwork.    STEP STEP 4 Click Submit After you enter your A Number and confirm it is accurate then click the large blue “Submit” button below the number.  STEP STEP 5 No Case Found? If it seems like nothing happened look to see if there is some red text that appeared above the “SUBMIT” button.  If it reads “No case found for this A Number” then the A Number you entered in not in the system, meaning that A Number has not yet been scheduled for a hearing or isn’t in Court. If you have a Notice to Appear with an A Number that matches what you entered and you get this message then it is possible that it is just too soon and it hasn’t been entered into the system yet. You can try again in a few days or call the Court if you are unsure.  STEP STEP 6 Case Information If the A Number does match a case in the system then a new screen will load with information about the case.  It will have your next hearing date & time, the type of hearing, whether it is in-person or virtual, and the name of the Judge. If a decision was already made on your case or your case was dismissed you will find that information there as well.  Case Status What?

EOIR “Experiencing Intermittent Systemwide Outages”

Email from EOIR on March 21, 2024, regarding system outages

Today, March 21, 2024, the Executive Office of Immigration Review (EOIR) sent out an email at 5:40 p.m. EST stating: EOIR has been experiencing intermittent systemwide outages and is working to ensure the issues are fully resolved. We will provide updates as appropriate, but please contact your local court with questions. We will issue new Notices of Hearing to those whose hearings were affected today. https://www.justice.gov/eoir/find-immigration-court-and-access-internet-based-hearings Since they provided the link to the internet-based hearings links, it seems they are referring to the Webex Virtual Hearings System. It also seemed that the Automated Case Status System Website was down earlier this afternoon. So if you had trouble accessing your Immigration Court Virtual Hearing today it wasn’t only you and there is no need to worry. The email from EOIR states that they will be sending out new hearing notices for those whose hearings were affected by the technical difficulties today.

Administrative Closure vs Termination vs Dismissal

Immigration removal proceedings may conclude with relief granted by the Immigration Judge or removal ordered. Cases may not reach conclusion for reasons such as eligibility for other immigration benefits or changes in circumstances, leading to prosecutorial discretion or legal motion to end proceedings. Termination, dismissal, and administrative closure are distinct ways to conclude proceedings, each with unique legal implications and consequences for the respondent’s immigration status and potential future proceedings. Administrative closure, unlike termination and dismissal, allows for the possibility of re-opening the case and maintaining employment authorization.
